Relevant ADR Client Representation Experience
1994-December 2018. Shareholder at Briggs and Morgan, P.A. law firm in the Twin Cities practicing in the areas of construction law, real estate/land use litigation, eminent domain and ADR. From 2010 to December 2018, served as Chair of Firm ADR and Construction Practice Groups. Represented owners, contractors, construction managers, subcontractors, suppliers, insurers, sureties and lenders in significant construction disputes in mediation and arbitration forums. Spent a significant amount of time in last ten years representing utility owners and professional sports team owners regarding the drafting and negotiation of contracts. Contracts included design; design and supply; design/build; furnish and install, Construction Manager at Risk; Construction Manager as Agent; General Contractor with General Conditions; General Contractor/Subcontractor agreements and EPC.
Served as lead negotiator regarding resolution of disputes while at Mortenson Construction.
Also represented clients in commercial (not construction) disputes involving mediation and arbitration including appeals from eminent domain commission awards; joint venture disputes between stakeholders; majority/minority shareholder matters; commercial real estate lease disputes and land use/zoning matters.
Relevant ADR Neutral Experience
Served as a neutral in over 900 mediations in the Upper Midwest region. Current member of the American Arbitration Association Construction Mediator Panel for Minnesota and surrounding states.
Recent mediations include disputes involving the expansion of a municipal landfill; applicability of exclusions under a construction insurance policy; the design and construction of an eight figure private residence; cross appeals from an eminent domain commission award; and a commercial lease dispute between landlord/tenant.
Served as sole arbitrator or on arbitration panel (many times as Chair) in over 225 construction dispute matters since 1984. Most arbitrations have been matters administered by the American Arbitration Association. Member of AAA Construction Panel, Commercial Panel; and Large and Complex Case Panel.
Recent arbitrations include disputes involving the design and construction of a high end private residence; the construction of a cold storage food distribution warehouse; the design and construction of a multifamily facility; interpretation of applicability and enforceability of a subcontract indemnification provision; and responsibility for payment of OSHA fines.
